
The New York Times reports:
A lawyer for John Eastman, the architect of a plan central to former President Donald J. Trump’s attempts to overturn the 2020 election, said on Thursday that he was “99.99 percent sure” that Mr. Eastman was among the unnamed co-conspirators mentioned in an indictment of Mr. Trump unsealed in Washington this week.
The lawyer, Harvey Silverglate, told CNN that he and the lead lawyer representing Mr. Eastman, Charles Burnham, plan to send federal prosecutors a memo arguing that Mr. Eastman was acting “as an attorney advising a client, that the advice was lawful, and that Eastman should not be indicted.”
“We are further going to say that if indicted, he is going to trial,” Mr. Silverglate said. “If convicted, he will appeal. This is not a case where there’s any plea bargaining in the future.”
